MEDICRIU, on its behalf under the brand "MEDICRIU” is the publisher and author of the internet resource www.medicriu.com & www.medicriu.in and the mobile application “MEDICRIU” (together, “Website”). MEDICRIU owns and operates the services provided through the Website (i.e., our internet resource “www.medicriu.com” & www.medicriu.in and mobile application “MEDICRIU-doctor and laboratory booking App”)

 

  1. Nature and Applicability: -

You are requested to read carefully our terms and conditions and privacy policy, which is available on www.medicriu.com before you decide to use/access the website and also before you decide to use/access the mobile application “MEDICRIU-doctor and laboratory booking App” or avail the services provided by the MEDICRIU.  These terms & conditions and privacy policy together form a legal agreement between you and MEDICRIU from all future legal complications and bindings, and that will be applicable when you use/access the website or avail the services (as mentioned below) provided by the MEDICRIU.

 

  1. This agreement contains the terms and conditions of MEDICRIU website.

 

  1. This agreement is applicable to all of the user of our website, who decide to use/ access our website or avail any of the services provided by MEDICRIU; and irrespective of whether you are: -

 

 

  • A patient; or family member, or relative, or friend, or any representative, or legal heir, or any well-wisher of patient; or registered as a patient on our website; searching for any doctors, or consultants, or practitioners, or laboratories, or pathologies, or clinics on our website; or decide to book an appointment with any doctors, or consultants, or practitioners, or laboratories, or pathologies, or clinics listed on our website.
  • A doctor, or consultant, or practitioners, or healthcare advisor; who is registered as a doctor on our website; or wishing to be registered as a doctor on our website and decide to take appointments from the patients who will book an appointment for in clinic check up through our website.
  • A laboratory or pathology or diagnosis Centre; who is registered as a laboratory on our website; or wishing to be registered as a laboratory on our website and decide to take appointments from the patients who will book an appointment for in-clinic check up through our website.
  • A clinic, or assistant of a doctor, or an attender of a doctor; who is registered as a clinic on our website; or wishing to be registered as a clinic on our website.

 

  1. This agreement is applicable to all those services which are available on Medicriu website, whether they are available at free of cost or not. These services include: -
  • Searching for any doctors, or consultants, or practitioners, or laboratories, or pathologies, or diagnosis Centre, or clinics by their name, geographical location, specialty; their contact details, address on our website by any user or you; or booking an appointment with any doctors, or consultants, or practitioners, or laboratories, or pathologies, or clinics for in-clinic check up listed on our website.
  • Creating an account on MEDICRIU website or registering and maintaining an account with MEDICRIU website by any user (End-user).
  • For doctors, or consultants, or practitioners, or laboratories, or pathologies-: to create an account on MEDICRIU website and maintain their account and contact details & address which will be available for other users or visitors of the website; and to take appointment from patients for their in-clinic check up.
  • For clinics-: to create an account on MEDICRIU website and maintain their account and contact details & address and update the information regarding their services (e.g., showing the accounts or profiles of the doctors or consultants or practitioners available on their clinic).
  • Such services provided by MEDICRIU are subjected to be changed from time to time at the sole discretion of MEDICRIU. MEDICRIU reserves the full power and right to change it’s services from time to time.
  • If any of the services provided by MEDICRIU website changes, modified, alters or stops as per the decision of MEDICRIU, then also this agreement will be applicable upon all the users (End-users) of the MEDICRIU website after such changes, modifications, alterations.

 

  1. This agreement will be applicable upon all the information or data provided to us by the users during the time of visiting the website or accessing or availing any of the services provided by MEDICRIU.

 

  1. MEDICRIU reserves the full right and power to change, modify, alter, terminate this agreement or any part of this agreement, at any time.
  2. By downloading or using or accessing our website or availing any of the services provided by MEDICRIU, you irrevocably accept all the terms and conditions of this agreement and to abide by them. This agreement supersedes or replaces all the previous written or oral communication, agreement with you (if any) regarding the terms of use of our website and availing any of the services.

 

  1. By using or accessing our website or availing any of the services provided by MEDICRIU, you acknowledge that you are bound by this agreement.

 

  1. Your using or accessing of our website or availing any of the services provided by MEDICRIU, depends upon the sole discretion of MEDICRIU. If MEDICRIU wants it can barred you from using or accessing the website or availing any of the services.

 

  1. All these provisions of this terms and conditions or this agreement between you and MEDICRIU is made as per the existing Indian Laws. Any dispute arising out of this agreement will be settled by an independent arbitrator, appointed under the provision of Arbitration and Conciliation (Amendment) Act,2019 and Courts in Kolkata will have absolute jurisdiction to adjudicate any dispute arising out of the Arbitration Proceedings. The Arbitrator will be appointed by the Medicriu. The rules, regulations, guidelines and clarifications framed thereunder, including the (Indian) Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Information) Rules 2011 (the “SPI Rules”), and the (Indian) Information Technology (Intermediaries Guidelines) Rules 2011 (the “IG Rules”).

 

 

  1. Conditions for use: -

You must be of minimum 18 years of age or above and a sound minded person when you use or access our website or avail any of the services provided by MEDICRIU. If your age is below 18 years of age, then you are requested not to use or access our website or avail any of the services provided by MEDICRIU.

  1. Registering with MEDICRIU and personal information: -

By registering with MEDICRIU, you irrevocably accept our terms and conditions and the privacy policy (i.e., legal agreement between you and MEDICRIU).

  1. Due to register with MEDICRIU, you need to put your valid mobile number or valid email-ID. We collect the mobile number or email-ID from all our users for communication purpose and with an intention to provide you a better service.

 Here is the brief of registration–

  • On mobile application: - You may register yourself either as a patient or doctor or consultant or practitioner or laboratory or pathology Centre or diagnosis Centre or clinic at the very first step on our mobile application MEDICRIU. On the next step you need to provide your mobile Number or email-ID and an OTP will be sent either to your mobile number or email-ID (which one you will provide). After putting that OTP your account with MEDICRIU will be created.
  • On internet resource ( medicriu.com )-Though you can search for doctor or consultant or practitioner or laboratory or pathology or diagnosis Centre or clinic on our internet resource i.e. www.medicriu.com without registering with MEDICRIU, but registration with MEDICRIU is required for any other uses.

 

 

  1. Information to be shown to other users: -

MEDICRIU collects information about the users for creating an account, some of those information will be shown to other users, e.g.-

  1. Phone number, address of the chamber of doctor; specialty of the doctor etc. will be shown to other users when a doctor or consultant or practitioner has registered him/her with MEDICRIU as a doctor.
  2. Phone number, address of the laboratory; list of tests done there etc. will be shown to other users when a laboratory or pathology or diagnosis Centre has registered it with MEDICRIU as a laboratory.
  3. Phone number, Address of the clinic; doctor or list of doctors attached to it etc. will be shown to other users when a clinic; or attender or assistant of any doctor has registered it; or him or her with MEDICRIU as a clinic.

 

  1. Data privacy policy: -
    1. The terms “personal information” and “sensitive personal data or information” are defined under the SPI Rules and are redescribed in the Privacy Policy.
    2. Medicriu may collect, store and use your personal data for the purpose of: -
  • Provide you better service: - MEDICRIU may collect and store your personal data and may use such data for the purpose of providing you better service.
  • For transaction purpose only: - For the purpose of transaction MEDICRIU may collect and store your personal data.
  • Marketing: - MEDICRIU may collect and store your personal data and may use such data for the purpose of their marketing.
  • Retargeting: - For the purpose of retargeting MEDICRIU may collect, store and use your personal data.
  • Analysis: - For the purpose of analyzing its customer MEDICRIU may collect, store and use your personal data.
  • Communication: - For the purpose of communicating and recommunicating with the users or customers, MEDICRIU may collect, store and use your personal data.
  • Other reasons.

 

  1. Medicriu May share your personal data to any third party, or for the purpose of enhancing their services.

 

  1. Doctor-Patient Relationship: -

 

  1. Not for emergency purpose: -The relationship between the patients (i.e., users of MEDICRIU or whoever book an in-clinic check up with doctor from the list of doctors available on MEDICRIU website or registered as a patient on MEDICRIU website) and the doctors (whoever registered himself/herself as doctor on MEDICRIU website) will not be for any emergency purpose. Only those Patients, who doesn’t have any emergency or immediate need are requested to book an in-clinic Check up through MEDICRIU website.

 

  1. In-clinic Check up only: - A patient himself/ herself; or his/her family member, or relative, or friend, or any representative, or legal heir, or any well-wisher of patient; or who registered as a patient on our website can book an appointment with the doctors listed on the website only for in-clinic check up. No video consultation appointment or home visit appointment (i.e., where doctor himself comes to visit patient) booking will be done with the doctors listed on the MEDICRIU website, through MEDICRIU.
  2. MEDICRIU is only a medium or platform where you can book in-clinic check up with the doctors listed on the website through the website. MEDICRIU will not be held liable, responsible or indemnified in any manner for any kind of behavior from the doctors or for any mental, physical or sexual harassment with the patients.
  3. MEDICRIU doesn’t have any control over the consultation fees of the doctors or consultant or practitioner or healthcare advisor. The consultation fees of the doctors will be solely decided by that doctors or consultant or practitioner or healthcare advisor.
  4. After completing the booking process MEDICRIU doesn’t have any kind of responsibility e.g., if the doctor is unavailable without any prior notification, or if the doctor doesn’t arrive as per schedule time.
  5. The consultation fees of the doctor or consultant or practitioner or healthcare advisor, which will be shown to other users will be updated time to time by that doctor or consultant or practitioner or healthcare advisor. MEDICRIU doesn’t have any kind of control if that doctor or consultant or practitioner or healthcare advisor demands any fees other than the fees shown in the MEDICRIU website.
  6. MEDICRIU doesn’t take any responsibility or MEDICRIU doesn’t have any control whether the patient is satisfied with the service or treatment or consultancy or suggestion of the doctor or consultant or practitioner or healthcare advisor. MEDICRIU only helps you in booking in-clinic check up with doctor or consultant or practitioner or healthcare advisor.
  7. MEDICRIU never suggest you or MEDICRIU doesn’t make any recommendations about doctors. We only provide you the list as per your search based on geographical location, specialization, name etc. After click on the search button, you will get an elaborate list based on your search, and from the list you can choose any doctor, which is totally depends on you.

 

  1. Laboratory-Patient Relationship: -

 

  1. Not for emergency purpose: -The relationship between the patients (i.e., users of MEDICRIU or whoever book an in-clinic check up with a laboratory or pathology or diagnosis Centre from the list of laboratories available on MEDICRIU website or registered as a patient on MEDICRIU website) and the laboratories or pathologies or diagnosis Centre (whoever registered itself as laboratory on MEDICRIU website) will not be for any emergency purpose. Only those Patients, who doesn’t have any emergency or immediate need are requested to book an in-clinic Check up through MEDICRIU website.
  2. In-clinic Check up only: - A patient himself/ herself; or his/her family member, or relative, or friend, or any representative, or legal heir, or any well-wisher of patient; or who registered as a patient on our website can book an appointment with the doctors listed on the website only for in-clinic check up. No video consultation appointment or home visit appointment (i.e., where healthcare service provider himself/herself comes for providing healthcare service) booking will be done with the Laboratories listed on the MEDICRIU website, through MEDICRIU.
  3. MEDICRIU is only a medium or platform where you can book in-clinic check up with the Laboratories or pathologies or diagnosis Centre listed on the website through the website. MEDICRIU is not responsible for any kind of behavior from the Laboratories or pathologies or diagnosis Centre; or for any mental, physical or sexual harassment with the patients.
  4. MEDICRIU doesn’t have any control over the charges of the Laboratories or pathologies or diagnosis Centre. The charges of the Laboratories will be solely decided by those laboratories or pathologies or diagnosis Centre. Medicriu will not be held liable for any non-refund of any services rendered by the Laboratories.
  5. After completing the booking process MEDICRIU will not be liable for any unforeseen event.
  6. Medicriu will not be held liable in any manner for any deficiency in service on part of the Laboratories.
  7. The charges of the Laboratories or pathologies or diagnosis Centre, which will be shown to other users will be updated time to time by those Laboratories or pathologies or diagnosis Centre. MEDICRIU doesn’t have any kind of control if any Laboratories or pathologies or diagnosis Centre demands more charges than the charges shown in the MEDICRIU website.
  8. MEDICRIU never suggest you or MEDICRIU doesn’t make any recommendations about Laboratories. We only provide you the list as per your search based on geographical location, specialization, name etc. After click on the search button, you will get an elaborate list based on your search, and from the list you can choose any Laboratory or pathology or diagnosis Centre, which is totally depends on you.

Only those Patients, who doesn’t have any emergency or immediate need are requested to book an in-clinic Check up through MEDICRIU website.
  2. In-clinic Check up only: - A patient himself/ herself; or his/her family member, or relative, or friend, or any representative, or legal heir, or any well-wisher of patient; or who registered as a patient on our website can book an appointment with the doctors listed on the website only for in-clinic check up. No video consultation appointment or home visit appointment (i.e., where healthcare service provider himself/herself comes for providing healthcare service) booking will be done with the Clinic listed on the MEDICRIU website, through MEDICRIU.
  3. MEDICRIU is only a medium or platform where you can book in-clinic check up with the clinics or attender or personal assistant listed on the website through the website. MEDICRIU is not responsible for any kind of behaviour from the clinics or attender or personal assistant; or for any mental, physical or sexual harassment with the patients.
  4. MEDICRIU doesn’t have any control over the charges of the clinics. The charges of the Clinics will solely be decided by that clinic only.
  5. Medicriu will not be held liable for any non-refund of any services rendered by the Clinic.
  6. After completing the booking process MEDICRIU will not be liable for any unforeseen event.
  7. Medicriu will not be held liable in any manner for any deficiency in service on part of the Clinics.
  8. The charges of the Clinic or attender or personal assistant, which will be shown to other users will be updated time to time by those clinics or attender or personal assistant. MEDICRIU doesn’t have any kind of control if any clinics or attender or personal assistant demands more charges than the charges shown in the MEDICRIU website.
  9. MEDICRIU never suggest you or MEDICRIU doesn’t make any recommendations about clinics. We only provide you the list as per your search based on geographical location, specialization, name etc. After click on the search button, you will get an elaborate result-list based on your search, and from the list you can choose any clinics or attender or personal assistant, which is totally depends on you.

 

 

  1. MEDICRIU will not verify the authenticity of the Doctor or Laboratory: -

 

The information/informations (i.e., the name, address, contact details, fees or charges etc. of doctors or consultant or practitioner or healthcare advisor; or clinic), which will be shown to other users, will be entered  either by that  user(i.e. doctors or consultant or practitioner or healthcare advisor; or clinic; or whoever registered himself/herself as a doctor; or whoever registered himself/herself/it  as clinic) or by the clinic and the information/informations (i.e., the name, address, contact details, fees or charges etc. of laboratory or pathology or diagnosis Centre), which will be shown to other users, will be entered  either by that  user(i.e. by that laboratory or pathology or diagnosis Centre).  MEDICRIU doesn’t have any liability to check or verify that information. MEDICRIU doesn’t have any liability to check or verify the registration no or license no of doctor or consultant or practitioner or healthcare advisor; or laboratory or pathology or diagnosis Centre. The informations which will be put by the doctors, or consultant or practitioner or healthcare advisor; or clinic; or laboratory or pathology or diagnosis Centre will be assumed to be true, original and fair enough. And if a clinic or attender or personal assistant of a doctor want to create a profile of a doctor or consultant or practitioner or healthcare advisor then it may create the profile of them, and in that case the informations will be assumed to be true. MEDICRIU does not have any responsibility to check any of the informations.  But if MEDICRIU wants it may check or verify the registration no or the license no of doctor or consultant or practitioner or healthcare advisor; or laboratory or pathology or diagnosis Centre, it will be the sole discretion of MEDICRIU.

 

     Any Clinic or attender or personal assistant if want, create and add profile of a doctor or consultant or practitioner or healthcare advisor after getting consent from that doctor or consultant or practitioner or healthcare advisor. If any such profile of a doctor or consultant or practitioner or healthcare advisor is created  by any clinic or attender or personal assistant of any doctor or consultant or practitioner or healthcare advisor, it will be assumed that after consultation and getting permission  from that doctor or consultant or practitioner or healthcare advisor, the profile is created and added by that Clinic or attender or personal assistant, and if such profile is created by any clinic or attender or personal assistant of any doctor or consultant or practitioner or healthcare advisor, or such informations and details  put by any clinic or attender or personal assistant of any doctor or consultant or practitioner or healthcare advisor in the time of creating the profile by any clinic or attender or personal assistant of any doctor or consultant or practitioner or healthcare advisor, it will be assumed that such doctor or consultant or practitioner or healthcare advisor has valid registration or license number from proper authority to practice anywhere in India or such informations or details put by  any clinic or attender or personal assistant of any doctor or consultant or practitioner or healthcare advisor will be assumed to be true and correct  MEDICRIU will not verify their registration number or license number, or but if  MEDICRIU want, it may verify or check their registration number or license number. If any informations or details put by any clinic or attender or personal assistant of any doctor or consultant or practitioner or healthcare advisor found to be incorrect or false, the liability will be totally come upon that clinic or attender or personal assistant of the doctor or consultant or practitioner or healthcare advisor.

 

  1. No liability for any damage or physical or mental or sexual harassment: -

 

MEDICRIU is not liable for any type of damage; or physical or mental or sexual harassment done in course of check up or treatment; or wherever. No compensation can be claim by anybody or any user from MEDICRIU.

 

 

 

  1. Service Charge: -

 

MEDICRIU charges some nominal fee for the booking or appointment of in-clinic check up, which will be known as service charge of MEDICRIU. The charges for every appointment or booking for in-clinic check up will be Rs.5/- only (five rupees only), which will include all the taxes. At the time of booking appointment, you will have to pay our service charge. After payment of the service charge your booking or appointment with doctors or consultant or practitioner or healthcare advisor; or laboratory or pathology or diagnosis Centre; or clinic, will be confirmed. There is no part payment or borrowing facility for the payment of service charge will be available. The service charge including all taxes will be Rs.5/- (five rupees) at present, but the service charge may change time to time. MEDICRIU has the sole discretion to change or waive or increase or decrease the service charge.

 

  1. Refund Policy: -

 

The service charge of MEDICRIU will have to be paid by the users or patients or whoever book an appointment for in-clinic check up with any doctors or consultant or practitioner or healthcare advisor; or laboratory or pathology or diagnosis Centre at the time of appointment. The service charge of MEDICRIU currently fixed at Rs.5/- (inclusive of all taxes) per each booking. If the user or the patient or whoever has booked the appointment, cancels the appointment 24hrs before the scheduled time of appointment, the amount of service charge (except 50% amount, which will be deducted for all taxes) will be credited or refunded to your account within 5-7 business days. But if the user or the patient or whoever has booked the appointment, cancels the appointment within just 24hrs from the scheduled time of appointment no refund will be given.  If the doctor or Laboratory, with whom an in-clinic check up or appointment has been booked, cancels the appointment, the full booking amount will be credited or refunded to your account within 5-7 business days.
